HERE ARE SOME RIGHTS YOU HAVE AS A BUYER:

GET YOUR OWN AGENT:

Is YOUR agent an "exclusive" buyer agent, or just a 'buyer' agent working for a LISTING BROKER? Will you end up paying for an agent that works for the SELLER, but NOT exclusively for you, the BUYER?" Understand the buyer agency relationship with your agent.

FREE CREDIT REPORTS TWICE A YEAR IN GEORGIA:

Do you know how to get them and to read them? As a resident of Georgia, you may receive TWO (2) credit reports per year from any of the THREE (3) credit bureaus that are normally used by mortgage companies to analyze your credit status. The credit bureaus are: Equifax (800-685-1111), Experian (formerly TRW) (888-397-3742), and Trans Union (800-888-4213). Talk with a mortgage representative to work on clearing up credit blemishes that will influence your ability to borrow money at a competitive interest rate to purchase your home. If they help you clear up the credit, they will also work with you to get you the best mortgage for your situation.

SELLER DISCLOSURES:

Will the Seller or Seller's Agent disclose ALL you need to know about the home? Learn of material information (on systems, structures, neighborhood, HOA strength, covenants, etc.) affecting your decision. Make sure your real estate agent negotiates your contingencies into your contract.

NEGOTIABLE EARNEST MONEY:

Is $500 enough? How about $1,000? $2,000? $5,000? Earnest money isn't "legally" required and there is no preset "minimum" amount, but is a "normal and accepted" practice of negotiating in good faith.

GENERAL INFORMATION:

How can you rely on information given to you by several sources? Consult with knowledgeable or experienced friends, relatives, local police, neighbors, CPA and/or Real Estate Attorney for advice although your experience will differ. Ask your exclusive buyer agent questions about what you are told to make sure you are being informed with credible information.

HOME INSPECTOR & YOUR HOME INSPECTION:

How do you choose a qualified home inspector? Have the home (even NEW home) inspected for material defects by someone who is exclusively a professional home inspector before you close.

MORTGAGE COMPANY:

Is your mortgage company being up front with you? Get a good faith estimate.

BETTER BUSINESS BUREAU:

You may want to check with them about any real estate related companies or service industries. You may visit their website at ATLANTA BETTER BUSINESS BUREAU

WARRANTY COVERAGE:

What voids a home warranty? Know what home warranties cover and what they "don't" cover. Usually "pre-existing" conditions are NOT COVERED.


HOMEBUYER BEWARE!!!

  • LISTING AGENTS work for the seller;

  • DUAL AGENTS work for both the buyer & seller (a conflict of interest) and legally can't disclose material facts about either party because the agents work for both parties;

  • DESIGNATED AGENTS work for the SAME BROKER and represent BOTH buyer & seller (a conflict of interest) and BROKER can't legally can't disclose material facts about either party because "both" agents from the "same" Broker work for "both" parties and are supposed to remain "independent".

  • BUYER AGENTS may be "LISTING" agents or work for a BROKER that lists houses and represent SELLERS.

"EXCLUSIVE" BUYER AGENTS... ...only represent & protect the "HOMEBUYER."
